Guardianship statutes and regulations vary from state to state. The Texas Estates Code is the statutory authority for Guardianship in Texas. Since 2007, professional Guardians in Texas must obtain and maintain certification to practice either in a for-profit business or a non-profit agency. The Judicial Branch Certification Commission, which is a division of the Texas Office of Court Administration, has created rules, standards and a code of ethics to which professional Guardians are held accountable. This course provides an overview of the Texas Estates Code (with a link to the appropriate sections for further study) and a discussion of the rules that specify who must be certified and what is required to maintain certification. Also included is a highlight of the Code of Ethics which is an important part of a professional Guardianship practice.

Author: Terry W. Hammond, J.D., N.C.G. Mr. Hammond is the owner of Terry W., Hammond Consulting. Mr. Hammond served as President of the National Guardianship Association in 2000, was Executive Director of NGA from 2006-2010, and was elected by NGA members to the Board of Directors from 1995-2006 and again from 2013 to present. Mr. Hammond presently chairs the NGA State Affairs Committee and the National Guardianship Network. Mr. Hammond is Executive Director of the Texas Guardianship Association and chairs the TGA Public Policy Committee. Mr. Hammond's law practice has focused on guardianship, adult protection, probate and mental health law since 1993. Most recently, Mr. Hammond has been hired by Judge Amanda Matzke and Judge Jim Locke in his home county of Brazos County, Texas, to assist in managing the county's burgeoning guardianship and probate docket. Mr. Hammond is frequently retained as an expert witness and consultant by guardians, guardianship programs, and legal counsel, and provides court-appointed advocacy on behalf of those in need. Mr. Hammond has a BS in Education, an MA in History from Texas A & Mand a JD from Texas Tech University School of Law.
