Because an adult has innate rights that are protected by statute and the Constitution, establishing a Guardianship in Texas includes extensive protections of those rights. Protections include, but are not limited to: statutory requirements to explore alternatives to Guardianship as well as supports and services, due process requirements and the appointment of an Attorney Ad Litem to act as counsel for the proposed person with an incapacity. This course discusses alternatives to Guardianship, the legal mechanics of filing a Guardianship application through the process of establishing a Guardianship designed to protect the rights of the person in need and the Bill of Rights for a person with a Guardian.

Author: Meghan Hutchinson, MSW NCG TxCG. Ms. Hutchinson has dedicated her career to guardianship and currently serves as the Director of the Guardianship Program at The Senior Source in Dallas, Texas. She began as a Guardianship Case Manager with The Senior Source in 2002. She earned her Bachelors in Social Work from Texas Christian University where she did an internship in guardianship with the Tarrant County Probate Court No. 2. She completed her Masters in Social Work from the University of Wisconsin-Madison. Ms. Hutchinson has been a board member of the Texas Guardianship Association for two terms throughout her career and currently seNes the board as Secretary. Meghan has been a Texas Certified Guardian since 2007 and a National Certified Guardian since 2002.
